Project summary

Which law applies?

Michaela Ribbing, PhD in Law, is a researcher and lecturer specialising in public law. Her research project aims to clarify which law should apply when legislation changes while a case is pending before a Swedish administrative court.* Transitional provisions are often lacking, leaving little guidance as to which law should be applied in such cases. This issue arises in part because substantive administrative law is heavily influenced by political decisions, meaning that legislation changes frequently.

*Sweden’s administrative courts comprise the Administrative Courts, the Administrative Courts of Appeal and the Supreme Administrative Court, as well as the Migration Courts. They hear disputes between individuals and public authorities, as well as between companies and public authorities. Decisions by public authorities such as the Swedish Social Insurance Agency, the Swedish Tax Agency or municipal social services can, for example, be appealed to an Administrative Court.
